Terms of Use Agreement

1. Introduction Welcome to Fit Firm and Fabulous. By purchasing our products, you agree to be bound by the following terms and conditions (the “Agreement”). Please read them carefully before using the products provided by Fit Firm and Fabulous (“Company”, “we”, “us”, or “our”).
2. Use of Products The products offered by Fit Firm and Fabulous are for personal, non-commercial use only. You agree not to misuse the products in any way that could damage, disable, overburden, or impair them or interfere with any other party’s use and enjoyment of them.
3. Privacy Policy Please review our Privacy Policy, which also governs your use of our products, to understand our practices.
4. Intellectual Property Rights All intellectual property rights in and to the products, including but not limited to design, text, graphics, logos, images, and software, are owned by or licensed to Fit Firm and Fabulous. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material without our prior written consent.
5. Purchase and Payment By placing an order, you warrant that you are legally capable of entering into binding contracts. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email that confirms that the product has been dispatched. The contract between us will only be formed when we send you the dispatch confirmation.
6. Refund and Return Policy

• Returns: You may return most new, unopened items within 30 days of delivery for a full refund. The items must be returned in their original packaging and condition.
• Refunds: Once we receive your item, we will inspect it and notify you of the receipt of your returned item. If your return is approved, we will initiate a refund to your original method of payment. You will receive the credit within a certain amount of days, depending on your card issuer’s policies.
• Exchanges: If your item is defective or damaged, we may offer an exchange instead of a refund. Please contact us to discuss exchange options.
• Shipping Costs: You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
• Exceptions: Some items may not be eligible for return, such as perishable goods, customized products, or sanitary goods. These exceptions will be clearly marked on the product description page.

7. Limitation of Liability To the extent not prohibited by law, in no circumstances shall Fit Firm and Fabulous be liable to you or any third parties for any loss or damage (including, without limitation, damage for loss of business or loss of profits) arising directly or indirectly from your use of or inability to use, our products or any of the material contained in them.
8. Disclaimer Fit Firm and Fabulous does not guarantee, represent, or warrant that your use of our products will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the products will be accurate or reliable.
9. Indemnity You agree to indemnify, defend, and hold harmless Fit Firm and Fabulous, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of our products or your breach of the Terms of Use.
10. Arbitration In the event of any dispute or claim relating to the products or this Agreement, the parties will attempt to resolve the dispute through friendly consultation. If the dispute is not resolved within a reasonable period then any or all outstanding issues may be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the [Arbitration Association]. The arbitrator’s award will be final, and judgment may be entered upon it by any court having jurisdiction within the jurisdiction of Maryland/USA.
11. Termination We may terminate or suspend access to our products immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms of Use. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law These terms and your use of the products will be governed by and construed in accordance with the laws of Maryland/USA, and you submit to the exclusive jurisdiction of the state and federal courts located in Maryland/USAfor the resolution of any disputes.
13. Miscellaneous If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provisions.
